Parental Leave in South Africa (BCEA Amendment 2023):
• Paternity Leave: 10 consecutive days for biological fathers
• Parental Leave: 10 consecutive days for adoptive parents
• Commissioning Leave: 10 consecutive days for commissioning parents (surrogacy)
• Leave must be taken within 4 weeks of the child's birth/adoption
• Leave is UNPAID unless employer chooses to pay or has a different policy
• Employee must have been employed for at least 12 months
• Cannot be taken concurrently with annual leave
Important: Unlike maternity leave, there is NO UIF benefit for paternity/parental leave. Payment depends entirely on employer policy.
